1. Access to the Platform

1.1 You must be at least 18 years old to access or use the Platform. By accessing or using the Platform, you represent and warrant that you are at least 18 years old.

1.2 KAFU CARD reserves the right to refuse access to the Platform to anyone for any reason at any time.

2. User Accounts

2.1 In order to access certain features of the Platform, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.

2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify KAFU CARD of any unauthorized use of your account or any other breach of security.

2.3 KAFU CARD reserves the right to suspend or terminate your account at any time for any reason without notice.

3. Use of the Platform

3.1 You may use the Platform for your personal, non-commercial use only. You may not use the Platform for any unlawful purpose or in violation of these Terms.

3.2 You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Platform without the prior written consent of KAFU CARD.

3.3 You may not interfere with or disrupt the operation of the Platform or servers or networks connected to the Platform, or disobey any requirements, procedures, policies, or regulations of networks connected to the Platform.

4. Intellectual Property

4.1 All intellectual property rights in the Platform, including but not limited to trademarks, copyrights, and trade secrets, are owned by KAFU CARD or its licensors.

4.2 By accessing or using the Platform, you acknowledge and agree that you have no ownership or proprietary rights in the intellectual property associated with the Platform.

5. Privacy

5.1 Your use of the Platform is subject to the KAFU CARD Privacy Policy, which is incorporated herein by reference. By accessing or using the Platform, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

6. Disclaimer of Warranties

6.1 THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KAFU CARD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS.

7. Limitation of Liability

7.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KAFU CARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM.

7.2 KAFU CARD' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE PLATFORM.

8. Governing Law and Dispute Resolution

8.1 These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE).

8.2 Any disputes arising out of or in connection with these Terms or your use of the Platform shall be resolved through amicable negotiations between the parties. If the parties are unable to resolve the dispute amicably, the dispute shall be submitted to the exclusive jurisdiction of the courts of UAE.

9. Amendments

9.1 KAFU CARD reserves the right to amend these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on the Platform.

9.2 Your continued access to or use of the Platform after the posting of any changes constitutes your acceptance of such changes.

11. Entire Agreement

11.1 These Terms constitute the entire agreement between you and KAFU CARD regarding your use of the Platform, superseding any prior agreements between you and KAFU CARD.

11.2 No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and KAFU CARD' failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

12. Severability

12.1 If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect to the fullest extent permitted by law.

13. Assignment

13.1 You may not assign or transfer these Terms, in whole or in part, without the prior written consent of KAFU CARD. Any attempt to do so without such consent will be null and void.

14. Survival

14.1 Sections 4 (Intellectual Property), 6 (Disclaimer of Warranties), 7 (Limitation of Liability), 8 (Governing Law and Dispute Resolution), and 10 (Amendments) shall survive any termination or expiration of these Terms.
